STATE OF MISSISSIPPI COUNTY OF CLAY NOTICE OF SUBSTITUTED TRUSTEE’S SALE Bank of Okolona is the owner of a certain deed of trust executed by Okie Smith, in favor of John A. Herrod, Jr., Trustee for the benefit of Bank of Okolona, Okolona, MS, dated December 11, 2014, and recorded in Land Mortgage Record Book 469 at page 337 of the land records of the Clay County Chancery Clerk’s Office; and WHEREAS, on February 21, 2018, Bank of Okolona did appoint and substitute Robert H. Faulks as Substituted Trustee, such substitution being of record in the Office of the Chancery Clerk of Clay County, Mississippi, and recorded in Substitution of Trustee Book 4 at page 742 [Instrument 2018000552]; and WHEREAS, default having been made in the terms and conditions of said Bank of Okolona Deed of Trust, Bank of Okolona having declared the entire remaining balance due and payable in accordance with the terms of said Deed of Trust, and Bank of Okolona, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the funds due thereunder, together with attorney’s fees, and Substituted Trustee’s fees, and expenses of sale; NOW, THEREFORE, I, Robert H. Faulks, as Substituted Trustee in the said Bank of Okolona Deed of Trust will on the 3rd day of April, 2018, offer for sale at public outcry, and sell within legal hours, being between the hours of 11:00 o’clock a.m. and 4:00 o’clock p.m., at the Front door of the Clay County Courthouse, at West Point, Mississippi, to the highest and best bidder, for cash, the following described property and any improvements, lying and being situated in Clay County, Mississippi, to-wit: Commencing at the intersection of the West right of way line of U.S. Highway 45 Alternate and the North right of way line of the Columbus & Greenville Railroad Company, which point is marked by a concrete marker, and from said point run thence North 0 degrees 11 minutes West along the West right of way line of said highway a distance of 625.7 feet to the Point of Beginning; thence run North 89 degrees 35 minutes West alone the North right of way line of Tubb Avenue, a distance of 300 feet; thence North 0 degrees 11 minutes West parallel to and 300 feet West of said West right of way line of said highway a distance of 154.5 feet; thence East 300 feet, more or less, to the West boundary line of said U.S. Highway 45 Alternate; thence South along the West boundary of said Highway 157.3 feet, more or less, to the point of beginning, and being a part of Lot 3, Block 99, Ward 3 of the City of West Point, Mississippi, according to the Arthur L. Goodman Map and Survey of said City. Said parcel also being described as Lot 5, Block 99, according to the Amended and Revised Arthur L. Goodman Map and Survey of the City of West Point adopted June 30, 1979. INDEX: Lot 3, Block 99, Ward 3 of the City of West Point, Mississippi, according to the Arthur L. Goodman Map, Clay County, Mississippi; and also being described as Lot 5, Block 99, according to the Amended and Revised Arthur L. Goodman Map and Survey of the City of West Point adopted June 30, 1979. The undersigned Substituted Trustee will convey only such title as is vested in him by virtue of the above described Bank of Okolona Deed of Trust.
