SUBSTITUTED TRUSTEE'S NOTICE OF SALE WHEREAS, on February 23, 2009, David R. Cochran and wife Nickii L. Cochran, executed a deed of trust to J. Patrick Caldwell, Trustee for the benefit of BancorpSouth Bank, which deed of trust is recorded in Deed of Trust Book 400 at Page 650 in the Office of the Chancery Clerk of the County of Clay, State of Mississippi; and WHEREAS, the aforesaid, BancorpSouth Bank, the holder of said deed of trust and the note secured thereby, substituted Underwood Law Firm PLLC, as Trustee therein, as authorized by the terms thereof, by instrument dated February 14, 2018 and recorded in the Office of the aforesaid Chancery Clerk in SOT Book 4 at Page 744; and WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said indebtedness, BancorpSouth Bank, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder, together with attorneyÂ’s fees, Substituted TrusteeÂ’s fees and expense of sale; NOW, THEREFORE, WE, Underwood Law Firm PLLC, Substituted Trustee in said deed of trust, will on the 18th day of April, 2018, offer for sale at public outcry for cash to the highest bidder, and sell within legal hours (being between the hours of 11:00 A.M. and 4:00 P.M.) at the East front door of the County Courthouse at West Point, County of Clay, State of Mississippi, the following described property situated in the County of Clay, State of Mississippi, to-wit: 2.015 acres situated in the SW 1/4 of the NW 1/4 of Section 33, Township 16 South, Range 6 East, Clay County, Mississippi, and being more particularly described as follows: Commencing at an existing iron rod at a fence corner marking the Southeast Corner of Section 33, Township 16 South, Range 6 East, Clay County, Mississippi, and run thence North 00 degrees, 18 minutes, 52 seconds West for 2,644.50 feet to an existing iron rod at a fence corner on the South side of a public gravel road known as "VA Road" thence continue North 00 degrees, 18 minutes, 52 seconds West for 38.00 feet, thence run South 87 degrees, 42 minutes, 44 seconds West for 759.36 feet to an existing iron rod; thence continue South 87 degrees, 42 minutes, 44 seconds West along the North side of said road for 433.15 feet to an iron rod at a fence corner; thence run North 89 degrees, 21 minutes, 35 seconds West along the North side of said road for 260.00 feet to an existing iron rod; thence run North 89 degrees, 05 minutes, 30 seconds West for 3,503.87 feet to an iron rod on the North side of said road for a Point of Beginning; thence run North 00 degrees, 38 minutes, 40 seconds East for 300.00 feet to an iron rod; thence run North 89 degrees, 08 minutes, 49 seconds West for 300.00 feet to an iron rod on the East side of said road; thence run along the East and North side of said road as follows: South 00 degrees 38 minutes 02 seconds West for 213.36 feet; South 21 degrees, 54 minutes, 34 seconds East for 36.04 feet; South 32 degrees, 25 minutes, 49 seconds East for 40.10 feet; South 56 degrees, 59 minutes, 19 seconds East for 27.14 feet; South 75 degrees, 55 minutes, 52 seconds East for 19.91 feet; South 88 degrees, 55 minutes, 07 seconds East for 221.97 feet to the Point of Beginning.
